Discrimination in Idaho

Federal and Idaho anti-discrimination laws make it illegal for employers to treat employees differently based on personal characteristics, such as religion or sex. Anti-Discrimination Laws & The Workplace

There are a number of federal and Idaho laws that are intended to counter discrimination in the workplace. Most of these laws were created to protect groups of people that have historically been treated differently not because of their abilities but because of some other factor. These groups of people are known as protected classes.

Anti-discrimination laws include:

  • The Age Discrimination in Employment Act of 1967, which bans discrimination against individuals who are at least 40 years old
  • The Idaho Human Rights Act and the federal Americans With Disabilities Act, which ban job discrimination against people with disabilities
  • The Pregnancy Discrimination Act, which prohibits employers from discriminating against employees who are pregnant
  • Title VII of the Civil Rights Act of 1964, which makes it illegal to discriminate based on race, color, religion, sex and national origin

Neither federal nor Idaho laws make it illegal to discriminate against people based on marital status, gender identity or sexual orientation. However, some cities (including Boise) have passed anti-discrimination laws that provide additional protections that are not offered by federal or state law. In 2012, Boise made it illegal for employers to discriminate against people based on sexual orientation or gender identity/expression.
