Florida Wrongful Termination

Florida is what's known as an at-will employment state. That means unless you have an employment contract or union collective bargaining agreement, your employer can dismiss you from your job at any time for almost any reason. But if a company terminates you for an illegal reason or in violation of an existing contract, it's known as a wrongful termination or wrongful dismissal. When Is it Illegal to Terminate an Employee?

Wrongful termination in itself isn't against the law. It is, however, illegal to fire an employee for discriminatory reasons. Under federal and Florida law, a company cannot terminate an employee based on the employee's:

  • Age (for workers aged 40 and older)
  • Disability
  • Race and skin color
  • Religion
  • Pregnancy
  • National origin
  • Genetic information

It is also illegal to fire an employee in retaliation for filing a discrimination claim.

You have 365 days from the day the discrimination occurred to file a claim.
