Banking Law

Banking law is a diverse and complex field of legal practice, comprising a wide range of different specialties under the general heading of banking and financial legal practice. Most banking law attorneys work with banks or regulatory agencies to ensure compliance with all applicable laws and statutes governing financial transactions but there are a few sub-areas within banking law:

  • Creditor's Rights
  • Mergers and acquisitions
  • Securities and investments
  • Debt management
  • Mortgages

Attorneys practicing in the field of banking law typically concentrate in one or two of these areas. Some specialize solely in consumer banking law, including debtor's rights and consumer credit issues, while others work with companies directly to assist them with the legal aspects of investments, mergers, and other bank-related corporate concerns. Large financial institutions may employ hundreds of attorneys to assist them with legal matters ranging from debt collection to compliance with current federal and state banking regulations.

Attorneys who focus on banking law must remain current with all federal and state regulations relating to their area of practice. Since financial regulations are constantly changing, this entails a great deal of continuing education in most cases.
