Class Actions in Louisiana
If you've been defrauded by a company, injured by a defective product or otherwise wronged by a company, it may not be cost-effective to sue the company in Louisiana court. That's why many people instead turn to class action lawsuits, which allow many people with similar claims against a company to have their disputes resolved through a single lawsuit. A class action attorney can evaluate your issue and tell you if a class action is right for you.
Class Action FAQ
What is a class action lawsuit?
A class action is a type of lawsuit where many people's similar or identical claims against a company are resolved through a single court case. A representative party or lead plaintiff is selected, and that person's claim is heard by the court. The resulting judgment or settlement applies to all claimants.
What types of lawsuits are appropriate for a class action?
Class action lawsuits are commonly used for disputes related to:
- Securities fraud
- Employment litigation
- Environmental toxic torts
- Defective products, including defective drugs and medical devices
- Consumer fraud
- False and misleading advertising
What types of legal disputes aren't appropriate for class action status?
Louisiana law sets out specific conditions that a lawsuit must meet to be certified, or qualify as a class action. Among these, there must be enough plaintiffs that it's impractical for them to all have their disputes heard in court, and there must be a similarity to the legal disputes. If only a few people have claims against a company, or if the claims are different from one another, it's probably not appropriate for class action status.
What if I don't want to be part of a class action lawsuit?
If you're not interested in participating in a class action, you have two choices. You can formally opt out, or notify that court that you won't be taking part in the lawsuit, but reserve the right to file your own lawsuit against the company. Or you can simply do nothing, which means you won't be entitled to compensation from the company if the class action is successful, but which also means you can't file a separate lawsuit against the defendant.
