Class Actions in Florida

Class action lawsuits are commonly used when many parties (the plaintiffs or class) have similar or identical claims against one or several companies (the defendants). If you have been wronged by a company and think there are others with the same dispute, talk to a class action attorney as soon as possible. Your lawyer can evaluate whether the case is right for a class action filed in either federal or Florida court.

Class Actions: Pros and Cons

Class action litigation is commonly used to resolve disputes in the following areas:

  • Employment law
  • Securities fraud
  • Defective drugs and medical devices
  • False or misleading advertising
  • Defective products

In many instances, class action lawsuits offer a cost-effective way to resolve a dispute against a company when it wouldn't make financial sense to pursue independent litigation. For example, imagine that you bought a product that cost $100 and promised certain health benefits. It was subsequently revealed that the product didn't delivery any of the advertised benefits. You probably wouldn't hire a lawyer to sue the company, since you'd spend more in fees than you could ever hope to recoup. A class action lawsuit allows those many plaintiffs who have been wronged by a company to get justice.

A class action lawsuit also allows companies to resolve many legal claims more efficiently. Trials take time, and if a company is sued by 100 or 1,000 plaintiffs, then it might be years before your case is resolved and before you receive any money.

The primary disadvantage of class actions: Even if the class action is successful, you might not receive as much compensation as you would have received if you'd filed your own lawsuit against the company. For this reason, the law gives you the opportunity to opt out of a class action and pursue a resolution on your own. It's important to realize, however, that once you've opted out, you can't later change your mind and try to collect compensation from the class.
