Penson (Member) born Athens, Ohio, September 10, 1956; admitted to bar, 1981, Florida; U.S. District Court, Middle and Northern Districts of Florida; U.S. Court of Appeals, Eleventh Circuit. Education: Ohio University (B.S.); Florida State University (J.D., 1981). Mr. Penson performed undergraduate work at Ohio University and the University of Florida receiving a Bachelor of Science Degree and completing a Government Honors Tutorial Program. He earned a Juris Doctorate degree from Florida State University and was admitted to the Florida Bar in 1981. He has been in private practice in Tallahassee for more than 20 years. Mr. Penson initially worked with a general practice law firm representing clients in insurance defense-related litigation, bankruptcy (both debtor and creditor), corporate matters (including formation of business entities, contracts, shareholder disputes, sale and acquisition of businesses and litigation), all real estate related matters (including title work, deeds, closings and other transactions or disputes), collections, family law (divorce, paternity and child support), probate, guardianship, wills and other issues related to individuals and small businesses. In 1987, Mr. Penson was invited to bring his litigation experience to a law firm in Tallahassee that performed work in construction related matters, from road and bridge building, to erection of large office and government buildings, sea walls and other marine structures across the Southeastern United States. In addition to representing contractors and owners of projects in litigation matters, Mr. Penson advised contractors and governmental entities in contracts, liens, employment issues, general business and real property matters. In late 1989, an opportunity arose for Mr. Penson to represent similar and other business related and banking interests across North Florida. At that time, he opened an office in Panama City and in Tallahassee which is the predecessor of the existing firm of Penson & Padgett, P.A. Mr. Penson represented clients in banking litigation, all construction matters, real estate, eminent domain, bankruptcy, corporate matters, contracts and civil litigation. As clients of the firm expanded, additional attorneys and staff have been brought to the firm which is now known as Penson & Padgett, P.A. He is a member of the United States District Courts for the Middle and Northern Districts of Florida, the Eleventh Circuit Federal Court and is a member of the American Bar Association, the Tallahassee Bar Association, Real Property and Probate Section and the General Practice of the Florida Bar. Mr. Penson continues to represent clients in business and corporate related matters and disputes, construction matters, real estate, eminent domain, liens, homeowner associations, contracts, collections, bankruptcy, probate, wills and other litigation. Mr. Penson has also served as a mediator and has arbitrated construction and business related disputes at the request of other attorneys. He works hard to be accessible to clients and to zealously represent them, while at the same time providing them with advice and counsel on their pending issues. When not representing clients, Mr. Penson is an avid fisherman, occasional hunter and a lousy golfer. He values his time with his family and has participated in many civic organizations over the years.
